Different companies will be given different advantages with having services over an extended period of time. When we"re thinking of trademarks it always deals with the rights of brands. There is the rise of the brand. You get more information on the topic in its most explicit form, you may not even get any information of it, many advertisements today will just target the brand. Theoretically, anything, including a: word, phrase/slogan, logo/design, distinctive shape, sound, smell, colour (some jurisdiction"s, tiffany blue is actually covered a case was made that people were associating that colour with tiffany. Exclusive national right to use the trademark. Right to be free of use of a confusingly similar trademark (also applies to unregistered trademarks) Evidence of ownership: owning a vimeo and youtube channel under the same name.
