Document Summary

Regulating essential service disputes in canada: the designation model. Public sector collective bargaining emerged in the 1960s, and efforts have been made to balance public interest and the collective bargaining rights of public sector employees. In canada, there are three historical models of essential service dispute regulation. Unfettered strike model: the most common model among blue-collar municipal workers such as garbage collectors. Government intervention through back-to-work legislation is a possibility under this model. No-strike model: this model prohibits work stoppages and relies on compulsory arbitration. Highly essential services such as police officers and firefighters commonly rely on this model: the no-strike model ensures maintenance of essential services, although there are fewer voluntary settlements, arbitration is connected to higher wage settlements. Designation rates are a key issue with regards to essential services. Historically, the government has over designated employees, which restricts the right to strike.
