Fundamental assumption: no society could exist that did not as the same time as having a shared political structure, have a shared moral structure. Society means a community of ideas; without shared ideas on politics, morals, and ethics no society can exist. To consider something illegal is fundamental predicated on judging something immoral. Even if you consent to being killed, it doesn;t justify or exonerate the act. A man cannot consent to an act of violence against himself and afterwards forgive it because this is an offence against society. Even if the act doesn"t harm another individual it is still harm as it harms society as a whole. There are certain moral standards of behaviour or moral principles which society requires to be observed. The harm to oneself doesn"t hold the human as intrinsically valuable. Criminal law reflects normative moral principles regarding human beings and their relations.
