The butler decision suggests that community standards of tolerance are based, at least in part, on the percepion of harm. Scc: the courts must determine as best as they can what the community would tolerate others being exposed. Used by pedophiles to recruit children for abuse. E. g. , evidence of harm direct and well veriied. Restricions on adult pornography, however not jusiied: any publicaioin a dominant characterisic of which is the undue exploitaion of sex, or of sex and crime horror, cruelty and violence. Far too vague and broad more discriminaing deiniion of bad pornography (the obscene) so as to map *add* Posited sources of harm connected with bad pornography : harm to the actors (parallel with child pornography, but exploitaion of actors not essenial to acivity as in child porn b. In place of this requirement the court has imposed a much lower jusiicatory threshold on parliament by demanding no more than a reasonable basis for the restricion.
