Federal Politics
• Why did Canada develop as a Federation rather than as a unitary state?
• Constitutional Federalism reflects the distinct linguistic, cultural, and social differences in
different areas of Canada
• Particularly between English Canada and French Canada
• Key questions coming out of this difference:
• Is Quebec one province amongst many or is it a separate nation?
• Can Quebec realize its aspirations inside of a majority Anglophone Federal Canada?
• Canada was colonized by the french and then the British!
• Francophone (french speaking ppl)!
• Quebec acts as a separate nation
• civil law (based on civil code In Quebec) and all other territories is based on the common law!
• Quebec acts as distinct society, not only is language!
• Several post-Confederation events have been highlighted by some as failures of English Canada
to respect Francophone interests:
1 Riel Rebellions (1870, 1885)
• Looey Riel - French catholic Metis leader, advocated for these ppl , he was in Manitoba!
• he was arrested in the rebellion in 1870 and was sentenced to death
• french Canadians looked highly at him!
• Sir John A McDonald allowed Riel to be hung!
• fracephones were not protected
2. Bilingualism in Manitoba (1890)
• Manitoba is established as a bi lingual province!
• immigration happens in Manitoba from english Canada
• francaphones are no longer in power!
• this became watered down!
3. Bilingualism in Ontario: Regulation 17 (1912)
• ended the use of french in public schools (can only have for the first 2 years of school and only 1
hour a day after that)!
• this was to make sure that Canadians were being taught english dominantly!
• The court says that regulation 17 is constitutional and it can stand!
4. Conscription in WWI
• Canada’s army is small in this time and the flow of volunteers slows down due to the severity of
the war!
• because of this conscription was put into place!
• this has a negative impact of quebecers because!
5. Conscription in WWII
