Document Summary
The areas of law that govern the relationship between the state and its citizens, and more particularly, through the use of state power" by the state in relation to and in relationship with its citizens. A set of series of formal and/or informal rules, norms and/or values that govern the relations and interactions between persons and/or organizations and are applied, interpreted or enforced by a judicial or quasi-judicial process. Formal versus informal (written) formal: written down i. e occupational liability act. Generally speaking, written laws can trump the common law" and judicial decisions that have taken place. Definitions: vague (unwritten) informal laws: interpretations. Constitutional conventions: constitutional law, history, representative system of government acting. Courts: given power to make decisions (argument of democratic or undemocratic) Litigation: until a court dictates so, the law won"t be interpreted against it in such a way. The charter of rights and freedom only applies to the government.
