If you are 13 or 15, you can consent to have sex with someone who is less than five years older than you: s 265. Basically, the judge will tell the jury whether the defense of mistaken belief of consent was reasonable: 273. 1. Consent is the voluntary agreement of the complainant to engage in the sexual activity in question. Consent cannot be given if you are incapable. Consent cannot be given if the defendant is in a position of power. Consent cannot be given if there is a lack of agreement.
