Law 201 week 9 lecture 9: torts law. A tort is a civil wrong between individuals for which the victim can get some legal remedy in the private law system. Accidents (personal injury) automobile, slip and fall. People in the wrong place at the wrong time. Private/civil law concerns torts because instead of violating social norms it violates the rights between individuals one of these individuals could be a corporation (also concern contract and property law). In private wrongs the goal is to compensate for harm. The proof in private wrongs is on the balance of probabilities 51% probable. There are six jurors who decide on the case. This is between two individuals: plaintiff and defendant. In some cases the same product can produce a public and private wrong: Lac megantic quebec train accident killed many people in the town. Train exploded because of the wrongdoing of individuals.
