Sentence ends at warrant expiration date
- If sentenced to five years, warrant expiration date is five years, that is when sentence
actually ends
- One of principals of judicial system, is in most/all cases you cannot be held past warrant
expiration date, after that government/state can no longer hold you accountable for a
crime
- That does not mean you will serve till the end of expiration date
- People get wrong idea that people are released from prison at the end of sentence
- Idea is when someone is in jail for five years, they are going to get out in five years but
that is not how it is
- Incarceration is a large part of a process
- Probation, parole is also part of tool kit
- Cold turkey- when you get released from incarceration at the end of warrant expiration
date, you stay in prison till warrant expiration date, usual reason is you are denied
parole, are not fit for parole
- This is not how we handle things most time, cold turkey is seen as a problematic issue
- More likely hood of success if re-entry into society at end of sentence happens in a
gradual way
- What research has shown, is making re-entry process more gradual and supervised
helps successful re-entry into society
Parole
- Formal word is conditional release
- Probation is part of sentence and parole happens at end of sentence
- Parole is seen as positive by authorities because you allow someone to gradually re-
entry society because prison is not best place for people
- They can re-build relationship with friends and family in community
- A gradual re-entry
- Swimming pool effect, most people will not be good by jumping in swimming pool, you
start at shallow end
- Probation is part of sentence judge hands out, parole is seen by parole board of Canada
- Parole is a privilege not a right
- Anyone who is serving a prison sentence, even if you’re in prison for only a week of 20
years your serving, you can apply for a temporary sentence
- Temporary sentence allows you to attend a wedding, funeral, major life event they want
to attend
- People are eligible for parole once they have served a third of sentence, or seven years,
whenever is shorter

- If serving a nine year service, after three years you can apply for full parole

- Statutory release date- after serving 2/3rd of sentence, someone who is unsuccessful at
getting parole, onus (responsibility) shifts from inmate to state, before statuary release
date person goes before parole board and says I should be granted parole, after
statuary release date someone state has to prove to parole board that they should not
be release
- Parole can be revoked, has same conditions as probation, maybe you cannot interact
with young people, consume alcohol
- People who break conditions of parole can be revoked

Process begins in prison
- Correctional staff begin drafting a document called release plan, tailored to individual
needs
- Each prisoner has a case management officer that sits down with prisoner and talks
about how they are going to manage that person re-entry into society
- Take into account what judge said, officials in inmates society
- Asks where you’re going to live, what you’re going to do for employment, who in the
community is going to help you reintegrate into society
- Research shows people who are most successful in reintegrating into society have
people who help them, have a support system in place that are going to help them
make that reintegration successful
- They do not want to hear you have no idea where you’re going to live, no prospects etc.
because evidence shows those people are likely to reoffend
- CMO also has to take into account risk or person
Parole board of Canada
- Supervises who gets parole and when
- Inmates have to show they are eligible and deserving of parole to parole board of
Canada
- Some people denied parole
- Parole board gets release document and have a huge amount of discretion, decisions
are not always transparent
- Parole board looks for evidence that person has reformed themselves, wants to hear
that you have a practical idea of how you’re going to turn life around and that you have
remorse, got job training, show remorse you have taken responsibility
- If person denies crime or not accepting responsibility they will not be rewarded parole
- Read through a lot of document, think about what judge thinks about, think of
background of person, first offence?
- On occasion will hear testimony of victim
