Document Summary

The role of the criminal law in defining aboriginal rights. Aboriginal people and the criminal justice system. Inherent- when asking for self-government, not asking anyone else for that authority. Entrenched- lawyers speak for what is in the constitution. Right is inherent and the recognition of it is entrenched. If we had the charter, but no longer had court"s, our rights wouldn"t mean very much. Could not do anything about it if the government did not play by the rules. Enforceable- need to be some sort of recognized process if things go wrong. Sovereign- equal status, want to be seen as sovereign within their own territory. Political institutions that are accountable to an aboriginal electorate- representative type of government, need for accountability- accountability to an aboriginal electorate. They get to vote and their decisions are binding. Seen as important as it is a group controlling its own political destiny.
