1CHAPTER 3 Issues Relevant to all Tort Law 1. The purpose of Tort Law is to compensate the victim a. through damages of various sorts, depending on the circumstances, and/or b. other non-monetary remedies, called equitable remedies, such as an injunction. 2. At a minimum, the victim (plaintiff) can only receive remedies through the courts if: a. the plaintiff can show that the defendant caused the injury, and b. the defendant cannot show that there are mitigating factors which may i. limit (contributory negligence), or ii. completely eradicate (voluntary assumption of the risk) the defendant’s liability.
