LAW 122 Lecture Notes - Lecture 7: Uberrima Fides, Rescission, Strip Mall
Document Summary
Expressions made during negotiations before contract was formed, no contract yet between the parties. Statement one party makes by words or conduct with the intention of inducing another party to enter into a contract. Types that don"t have expressions, statements people cant make a reasonable basis to enter into a contract: What someone might say to get you interested in a product ie. sales pitches, ads, promos, etc. No legal consequences (smoke, hot air) marketing, a lot of them don"t actually have legal weight. Person making a sale would be a puff and would not be the basis for legal contracts. Could maybe be too correct about feelings but cant sue them because you aren"t happy with preliminary statements. Going to buy a specific product then you can receive a representation, you can argue that is what you factually relied on that made you decide to go and enter into that contract on a basis.
