Today"s class: review of last class, last class- spoke about individual liability, class before last class- spoke about liability of the corporation, chapter 12: sentencing, final exam review. Dynamics between individuals and corporations when charges occur. Dynamics occur when two or more persons are charged as parties to the same offence. Normal rule is that they usually should be represented by different lawyers. Interesting discussion about group pressure as influence on individual behavior. Reference to acquired situational narcissism and christopher lasch"s work. Could be tremendous pressures on individual to go along with the group (economic, psychological and otherwise). This chapter discusses sentencing principles as well as a very recent development with respect to contracts with government. Recall that sentencing is part of risk communication from courts to the general public (chapter 1): for example, sentencing can undercut the government"s risk assessment by making the fine too low.
