Lawsuits are causes of legal action taken by one or more private bodies against another. Prosecutions on the other hand are public in nature and brought about by the government or government agency through its legal department. The outcome may be imposition of fines, imprisonment or both. Primarily, inspections, orders and directions are a means of ensuring a safe workplace. Where all fails however, the last avenue available to government regulators is prosecution. Mol outlines the objectives behind the initiative which is similar to that of ohs laws. Improve the health and safety culture of workplaces: reduce workplace injuries and illness, avoid costs for employers and the workplace safety and insurance board (wsib), and, provide a level playing field for compliant companies. Lessen the burden on the health care system, Violation of ohs laws (provincial ohs acts, canada labour code ii and their regulations) is usually the primary reason for ohs prosecutions.
