Legislative requirements: there are legal requirements to engage in investigations. Investigations can be either: (cid:862)internal(cid:863) = do(cid:374)e (cid:271)(cid:455) the e(cid:373)plo(cid:455)er, (cid:862)external(cid:863) = done by the inspector. "joint investigation" by management and worker representatives done in some cases it is up to management to conduct the investigation and to come to one of several conclusions. Investigation by inspector: an inspector shall investigate the refusal to work in consultation. Inspector must decide whether a circumstance is likely to endanger the worker or another person and must give their decision, in writing, as soon as is practicable. Duty to investigate - jhsc: where a problem has been identified at a meeting of the joint health and safety. Internal investigation = done by employer and reported to mol: not a very thorough investigation given the time constraints. Example: a worker falling off a step ladder. Interview techniques: put the interviewee at ease.
