If there is a person being attack that isn"t defending himself, someone else can act as their agent this counts too. Ex. a small child cannot defend him/herself, so a third party steps in. Can be deterrent if you know that people are obligated to use self-defence it may deter you from committing crimes: do not kill unless one is very angry at the victim. This would not have the best impact on society. And people can argue whether the death punishment actually deters people from committing crimes. Hospers: is saying that many people have thought this but it can be argued. In statistics: capital punishment study showed that for every 1 person murdered in capital punishment, 3 people are saved. But it is whether the rule would generate the greatest utility this is where empirical evidence is very important: do not kill except when killing will do the most good (maximize net benefits over harms impartially)
