Chapter examines circumstances in which accused person may successfully raise defence to criminal charge when she/he has acted in self defence/defence of others/defence of his/her property. Chapter reviews remaining 2 major defences that may be raised in response to criminal charges in canada. Cc provisions concerning self-defence & defence of property were completely rewritten in march 2013. Rather than substantial change of core legal principles, new laws designed to reflect how laws were being applied in practice w/ intention of streamlining overly complex area of law. New provisions will almost certainly be interpreted in light of substantial body of case law that had addressed self-defence prior to revision of cc in 2013: 34. Defence requires accused persons to raise reasonable doubt that they/another person were being assaulted & that as result, actions in defending themselves were reasonable in all the circumstances.
