Document Summary

Conditional discharge: put on probation and have to make these conditions (can last up to 3 years) Discharge: deemed guilty but not convicted: the judge suspends" the passing of a sentence for a particular period of time during which the offender is on probation. If the offender follows the rules and completes their probation, no sentence is given, But they are deemed convicted and will still have a criminal record (unlike discharges) If the offender does not complete the conditions or commits a new offense, they can get any sentence for the original offense plus any sentence for the new offense. If the violation is relatively minor: addition or removal of optional conditions. If a condition is being imposed unfairly on the offender they might remove it, or if they determine the offender needs more conditions they might add them: suspension of the conditional sentence.
