Finishing Family Law 11/27/2013 11:39:00 AM Last class we looked at FLA and Divorce act Now looking at custody and access: Divorce Act- uses language custody and access FLA- more modern language, parental responsibility and contact Custody- in law-means a person who is responsible for the day to day well being of the child Access- the right of the child to spend time with people who are important to them ^this is why support and access are different kinds of custody available under divorce act sole custody- you have custody split custody- you have more than one child, they don’t like to split up twins and they don’t like to split up siblings unless it is in the best interest of the child joint custody- when you both get it guardianship- anyone who can make decisions for the child legally if mom and dad break, mom may have court avoids these cases- looks at the best interest of the child- only thing that they look at in divorce act nothing that explains it, sec 18 of the FLA has a long list
