He explains how it is a false sense of kinder rehabilitation, where society believes they have left behind the cruelty of traditional punishment. He explains how in today"s society punishment has become therapeutic, but it is still equally demanded. The one commonality in punishment is, only legitimate motives for punishing are the desire to deter other by example or to mend the criminal. (lewis, p. 490). He argued that when this theory is combined with the thought that crimes are caused due to pathological reasoning, the de nition of punishment falsely changes in the eyes of society. The criminal who is being hung or is being sent to therapy is doing either one because the law require them to, their personal choice does not hold any merit.
