FOUNDATIONS OF LOCAL GOVERNMENT  FEDERAL SYSTEM OF GOVERNMENT  CONSTITUTION DOES NOT REFER TO LOCAL GOVERNMENT  S.92(8) – MUNICIPAL INSTITUTIONS IN THE PROVINCE o Gives provinces control over municipal institutions within a province o S.92(13) gives the provinces power over property rights and civil rights o Demographic shift made it so that urban governance became a key political area  COURTS OF THE QUARTER SESSIONS – JUDICIAL, ADMINISTRATIVE AND LEGISLATIVE RESPONSIBILITIES  BALDWIN ACT (1849) – FIRST MUNICIPAL ACT o Represented the first attempt to organize municipal government. It’s been revised a lot.  MUNICIPAL ACT, 2001 – FIRST COMPREHENSIVE REVIEW AND OVERHAUL IN 150 YEARS o CAME INTO EFFECT ON JAN. 1, 2003 o The old Act was too complicated so lots had to be changed o NATURAL PERSON POWERS o Identify 10 SPHERES OF JURISDICTION for local government – HIGHWAYS; TRANSPORTATION SYSTEMS; WASTE MANAGEMENT; UTILITIES; CULTURE, PARKS, REC & HERITAGE; DRAINAGE/FLOOD CONTROL; STRUCTURES; PARKING; ANIMAL CONTROL; ECONOMIC DEVELOPMENT o GREATER ACCOUNTABILITY o ONGOING CONSULTATION o *inclusion of natural persons power which enabled local government the right to enter into agreements, right to hire employees and right to make purchases WELLINGTON COUNTY  CITY OF GUELPH (SEPARATED)  TOWN OF ERIN  TOWN OF MINTO  TOWNSHIP OF CENTRE WELLINGTON  TOWNSHIP OF GUELPH-ERAMOSA  TOWNSHIP OF MAPLETON  TOWNSHIP OF PUSLINCH  TOWNSHIP OF NORTH WELLINGTON  LOWER-TIER – ALL 8 ARE LOWER-TIER MUNICIPALITIES  UPPER-TIER – CORPORATION OF THE COUNTY OF WELLINGTON o 16 MEMBER COUNCIL (MAYORS OF 7 MUNICIPALITIES & 9 DIRECTLY ELECTED WARD COUNCILLORS o CITY OF GUELPH IS NOT A PART OF THE UPPER-TIER MUNICIPALITY  STRUCTURE OF LOCAL GOVERNMENT  LOWER-TIER o URBAN – CITY, TOWN, VILLAGE o RURAL – TOWNSHIP, PARISH, RURAL MUNICIPALITY  UPPER-TIER o COUNTY – RURAL AREAS o REGIONAL MUNICIPALITY / METROPOLITAN MUNICIPALITY TWO-TIER GOVERNANCE IN ONTARIO  FIRST EXPERIMENT – MUNICIPALITY OF METROPOLITAN TORONTO (“METRO”)  “METRO” TORONTO o CREATED JAN. 1, 1953 o ORIGINALLY 13 MUNICIPALITIES - 12 SEATS FOR CITY AND 12 FOR REMAINING MUNICIPALITIES o 6 LOWER-TIER MUNICIPALITIES SINCE 1967 WITH TORONTO GETTING 12/32 SEATS o INDIRECTLY ELECTED o No city was part of an upper tier municipality before 1953. Toronto was the first to be though  4 ADDITIONAL UPPER-TIER MUNICIPALITIES IN THE GTA – HALTON, PEEL, YORK & DURHAM  OFFICE OF THE GTA – CREATED IN 1988 o Report to cabinet minister, foster communication between upper tiers
