Thesis: hungary and poland will have no choice but to comply with ecj sanctions and revise their constitutions. The eu was aware there would be no uniform code for democracy but it was difficult to imagine what would ensue (keleman, 2017). There is a consensus among the literature that it is common for authoritarian enclaves to persist at the subnational level of democratic regimes (keleman, Judicial review can be explained by three factors, individual preferences, intra-court interaction, and the influence of other relevant actors such as other levels of government and citizen influence (kantorowicz & garoupa, 2015). These factors vary in degree, but these three factors can be used to describe judicial review globally (kantorowicz & garoupa, 2015). Due to a socialist scandal prior to the 2010 election, orban was elected with 53% of the vote which translated into 68% of the seats in hungarian parliament (kelsen, 2017).
