Goals: protection, protection of law abiding persons against criminals, reduce crime/get tough on crime approach, difference between criminals and non-criminals, deterrence, deter crime through punishment, punishment, prison sentences/harsh punishments. Assumptions: punishment, presumption of guilt, officials, trust officials because they want to protect us, errors, few/no errors occur, legal rights. Impede/disrupt investigations: administration of justice, putting criminals away will make for better order. If there is a conflict in the administration of justice, protecting society/the public is favoured. Case example: r. v. hall (2002 scc 64) Wednesday january 18th, 2016: 1st degree murder, supreme court decision deny bail for protection of society; upheld trial decision, uphold public confidence and public safety, on intuitive level we (society) agrees with this. Goals: protection, protecting individuals from the powers of the state, prevention, of convicting innocent persons, legal rights, wrongful conviction, correction in the system, emphasis, fairness and equality should exist at all stages in the system, emphasis on justice.
