Document Summary

In hearing criminal cases especially, somebody could be held in detention, which is seen as problematic because the person hasn"t been convicted yet. Causes result from crown trying to get the plea bargain. Could be procedural because there is no courtroom or judge. Issues with evidence trying to get it to court or the people who are presenting it to court. Charter rights: sec 11 (b) (tried in reasonable time) - R v. askov (1990) 3 men were charged, denied bail and released on bail about 6 months later. They didn"t go to trial until another 3 years: charges stayed dropped charges and conviction because the court found it was too long of a time. Social science (evidence) had people look at the time and found that peel had the lengthiest delays in. Victims suffer and public can lose trust in system.
