Nov. 8, 2012 (Transportation) November-08-12 12:30 PM Transportation  Constitution Act, 1867, does not classify “transportation” as a class of subject assigned to any one level of government.  Transportation matters are scattered throughout the CA,1867.  In general, jurisdiction of interprovincial or international transportation-federal.  Feds have power over S.91: Works connecting the provinces.   Provincial powers (s. 92)  Local works and undertakings.  Property and civil rights.  Matters of a merely local or private nature in the province.  Interprovincial W & U:  Test is whether the interprovincial or international are “continuous and regular.”  Integration of local and interprovincial regulation has other implications.  Internet Related Undertakings  Regulation falls within the definition of provincial undertakings.  Must, therefore, fall to federal legislation.  Does Canadian copyright law extend to protect music downloads in Canada from a foreign country via th
