Constitution Act, 1867, does not classify “transportation” as a class of subject assigned to any one
level of government.
Transportation matters are scattered throughout the CA,1867.
In general, jurisdiction of interprovincial or international transportation-federal.
Feds have power over S.91:
Works connecting the provinces.
Provincial powers (s. 92)
Local works and undertakings.
Property and civil rights.
Matters of a merely local or private nature in the province.
Interprovincial W & U:
Test is whether the interprovincial or international are “continuous and regular.”
Integration of local and interprovincial regulation has other implications.
Internet Related Undertakings
Regulation falls within the definition of provincial undertakings.
Must, therefore, fall to federal legislation.
