Look back at week 2 to see different sources of law. It is usually more expensive to remediate than to prevent in the first place. It seeks balance between environmental rights (to be free from environmental harm) and economic/social rights (ex. We view environmental cases from a private view but not the way to go (the environment is not a private entity) Cases where a large group of people sue a big company are not successful because people cannot prove that they have proprietary interest on the environment (public nuisance) Bringing in lawsuits is expensive for private individuals. Canfor: forestry company that started a forest fire. Damages: forest that burned down (timber) but there is also a designated area for conservation (intrinsic value) Would bc actually lost something if they were not going to sell the timber on that land anyway: we"re not saying you didn"t lose something, but if you did, you didn"t.
