Zoning is very static, doesn"t respond well to changes. Zoning is a purely regulatory approach, precisely what you can and cannot do with a piece of property. In response to these weaknesses, new tools introduced in planning act which allowed municipalities to respond more quickly than zoning, to try and anticipate future, allowed for temporary uses, etc. In short zoning, only restricts to prevent the worst and only inhibits the best. Under heading extra legal zoning, to respond to market changes, rezones happen frequently. One of complaints is that many applications, nothing certain even after an official plan is improved, next day there are still applications to amend. That"s why we have limitations to appeal for brand new official plans and zoning by law during a time period. This touches on one of traditional roles of zoning which is to separate land use, to minimize nuisances.
