Argues the prevalence of site specific zoning is lessening the original purpose of zoning, creating need for other techniques. Hamilton harbour commissioners v. city of hamilton (1998) Zoning can accommodate technical changes but not particularly well. 2 options for final approvals: zoning system. Uses set out in advance, predictable and certainty: development permit system. Case-by-case approval: ontario system is a blended system exemplified by niagara escarpment plan. Is a provincial plan, land form based plan. Idea was that province would take the unique feature and establish separate regime to deal with planning for it. Zoning is suspended except in urban areas and instead there is a pure development permit regime. Ran a quarry in place since 1900, wanted to develop second phase which required de- watering: argued that it is not a development, within the meaning of the act.
