Provincial: a person commences separation proceedings, claim for support and child custody falls under the applicable family law legislation. In ontario, divorce heard in superior court and child protection and adoption heard in the provincial court of justice. Both courts can hear: child and spousal support, child custody and access. But, ontario simplified uniformed courts exist family court branch of superior crt. Divorce prior to 1968, was socially and legally prohibited. Cohabiting partners: no obligation for mutual support and children from these unions were not considered part of the family. A child"s status: either: legitimate child of marriage, or, illegitimate child of cohabitation. In m v h (scc, 1999) same-sex couples gained the same legal recognition as opposite- sex couples.
