Ethics is about what we should/should not do. Rights exist whether you want them or not. Fallacy: a mistaken belief, especially one based on unsound argument. The assumption that because things are a certain way, they should be that way. 2nd assumption: just because something is not now occurring, it means it should not occur. Status quo should be maintained simply for its own sake.
