Under statute law government may describe the same activity as an offense and impose a punishment. The constitution establishes basic institutions of government, reflects some fundamental values of society and determines the values or goals that all other laws must reflect. Purpose of rule of law prevent arbitrariness by setting out strict rules the democratic system deters those who are granted these powers from acting impulsively.
