Document Summary

Morris- persons and punishment: morris argues that. This right is derived from the human right to be treated as a person. This right to be treated as a person is natural, inalienable and absolute. To explain this interest morris contrasts two systems- system of punishment and system of therapy. Morris gives three justifications for punishment: 1. ) Those who comply need some assurance that others will do so as well, otherwise their motivation to comply will weaken. The violator by taking on liberty, has not borne the burdens that others have to. This interest we have is our right to be treated as persons: unless we have the right to be treated as persons, we have no rights and others have no rights against us. Argues that we have the right to punishment by comparing two different systems of social control: the punishment system and the therapy system.
