SOC301H5 Lecture Notes - Lecture 4: Provincial And Territorial Courts In Canada, 18 Months, Risk Aversion
Document Summary
Remand and pre-trial detention essentially mean the same thing. These refer to the temporary detention of accused persons in provincial or territorial custody prior to trail or a nding of guilt. During the hearing, the court hears of evidence on both sides, and acknowledges the details of the case. The court then has to decide whether the accused if they should be bailed or if they should be put into remand or pre-trial detention until the real hearing (which would decide innocence or guilt). Legal conditions exist under which the accused can be detained in remand. Ensure attendance in court: where detention is necessary for the protection or safety of the public. To maintain public con dence in the justice system: 11 of the charter states that one must not be denied bail without a just cause. So they have to be careful in deciding who they do not bail out as it may violate their rights.
