Document Summary
First degree murder: second degree murder, manslaughter. 222 (1) a person commits homicide when, directly or indirectly, by any means, he causes the death of a human being. 222(4) culpable homicide is murder or manslaughter or infanticide. Infanticide - no minimum, max is 5 years imprisonment. The actus reus for all homicide o ences is causing the death of another human being. The actus reus is therefore all about consequences and causation - topics we have already covered. The central issue for the actus reus in homicide cases is causation. The consequences requires for the actus rest is the death of a human being - it becomes necessary to determine whether the accused"s actions actually caused that person"s death. In canada, we have generally taken a broad approach to causation. The accused"s acts don"t have to be the only cause of death. There can be other contributing factors, including the victim or complainant"s own vulnerabilities.
