Crime and mind lecture 4 battered women syndrome: women resulting to violence who have been previously abused, attack when not attacked directly. Typically convicted of second degree murder under this defence. Not a full defense, in homicidal case, reduces murder to manslaughter. If the person who did it in the heat of passion, or by provocation. Started off as partial justification not excuse. Changed the law about battered women, can now plead provocation as partial defense. It is not possible to plead under normal circumstances, law has even when occurring later in the uk: self defense: We need to extent self defense in some way: groups excluded from the right to defend themselves: Wives could not claim when husbands were chastising them. Something unique about violence occurring over time in a relationship where there is lack of circumstances to escape violence. Therefore, women taking pre-emptive steps to kill the man should be taken into special consideration.
