WDW215 Lecture #4 Legal professions trains hierarchal individuals Ethnographic observation, good clear detailed description of the courtroom, where people are placed/seated, what they are saying, the gendered separation (if any) - First person is okay - Draw on themes in the court - The haves and have not’s - RP and one shoter - Rationality - How the profession of lawyers build hierarchy, lawyers bow to judges … etc - Look at visibile minorities, women/men, white, underprivileged Debate - Drawing on outside resources, themes in class - How one is able to articulate Movie: The Paper Chase - A individuals first year in law school (harvard) - Look for how, discipline and hierarchy is manifested in the classrooms - Professor Kingsfield asking Mr. Hart to stand and talk loudly, signifying power relations - Professor’s way of teaching the class is a example of hierarchy, professor > student - Grades is emphasized and reinforced as an important element in law school - Everyone went to well known prestige schools - Kingsfield’s way of lecturing is Q, A, Q, A different type of discipline, on going Q, keeping the mind on going - According to Hart law school is full of uncertainty, who will turn into the next JP…etc - Three types of groups, the ones that given and don’t sit in their assigned seats sit at the back of the classroom, the ones that wont volunteer but when called upon will try their best, and the ones that will volunteer and keep up The professional expectations - Putting human experiences into siloe, the person who suffers is being dehumanized, from that persons lived experienced, its what that rule came about, your personal experience is not relevant - Example of elite, awkward to find a student that graduated from Minnesota to be at Harvard - Competition is huge example of hierarchy - Law firms having ranking, having gone through something before, you want the younger people to have gone through what you have, the position of power - Classroom being a Socratic method teaching style - Law school was dominated by men, but now dominated by women - RP and OS - There is no right answer in law, constantly questioning - Breaking down in inevitable, the third dimension of power, subtle but very powerful How Professions get established - The 3 main learned professions in society 1. Clergy 2. Medicine 3. Law - Transformation of an occupation into a vocation with specific attributes 1. Specialized technique supported by a body of theory 2. A career supported by a association of colleagues 3. Of a status support by community recognition 4. Division between the client and the practitioner 5. High degree of autonomy - Wilensky, Theory of how professions are developed (in stages) 1. Full time occupations 2. University affiliation of training schools 3. Professional associations are started 4. State licensing laws 5. Formal code of ethics The point of profession is to get control of the market (CT) - Whether or not certain people with certain training get control over the market - Special knowledge and skills become a scarred resource, commodified - As a economic need, ideological need to line education in the market start to need to justify their existence, prove that they need to be charging that money CT of professionalization 1. The differentiation in standardization in professionalization 2. Formalization of the conditions for entry 3. Persuasion of the public that they need services that the profession can provide 4.
