Document Summary
The application/embodiment of the idea that is patent. Patents provide exclusive rights to (cid:498)practice(cid:499) to manufacture, to use or to sell an invention and can prevent other people from practicing your invention. Useful (has to serve a useful purpose- cant be merely aesthetic) Not obvious (cant patent a cup for purpose of drinking water, a roof for keeping you out of the rain- has to be something innovative- has to be an inventive aspect to them) Patents last for 20 years after filing date (date of 1st application) and cannot be renewed once it"s done its public. Ever greening- take a drug that"s about to expire and file an application for some trivial improvement thereby domain. If claims are different, can be used for a different invention (using for something for just being sick vs using something for cancer) seeking to get another 20 years of protection.
