Concerned with interactions between private parties and the state. Most obviously criminal law, constitutional law (but also: administrative law, tax, law municipal law) Most obviously: tort law, contract law, property law (but also: unjust enrichment) Tort law is a varity of private law. Most generally, tort laws governs carious involuntary interactions between private individuals. Ex: negligently hit you w my car. You don"t ask to be hit, and the relationship that we enter into as a result of me hitting you isn"t one to which you consented to. Still, tort law imposes obligations on me, and makes me liable for certain damages i thereby cause you. Compare that situation with the interactions we find in contract law. In contract law, two parties voluntarily come together to form a contract. One party offers, the other party accepts, and considerationpasses from one to the other; in short, a contract is formed.
