Today’s Headlines 9/18/2012 6:49:00 AM Germany bailing out Greece still in the news  Germany is the European powerhouse  Is Greece fails, it will soon follow that Italy, Spain Portugal, etc. will fail  Eventually Germany and France will fail causing the European economy to collapse  In Europe the vast majority of capital is held in banks, and that capital is used to invest in North American countries o If the EU fails, the capital investment from the EU stops and our economy would take a hit What is Law 9/18/2012 6:49:00 AM What is Law?  Law – a set of rules imposed by the state that are enforced  Morgantaller doctrine – courts do not have the power to change the verdict of a case originally decided by a jury  The law is constantly evolving  Social utility – social benefits that serve to the greater good of society (valid laws follow social utility)  Legal realists – say the law is arbitrary and that it is completely up to the judges’ discretion  The law tries to take all the stakeholders interests (students, parents, teachers, employers) into account to achieve a balance Common Law/Cases  Every case that has been decided in our court rooms is a law  Precedent – new cases will always look at the decisions of past cases in order to get a verdict o Advantages  Efficient  Predictable  Fair  Uniform o Disadvantages  Doesn’t allow for flexibility or change in the law  The facts of two cases are never identical so precedent is simply an outline of what should be done Constitutional Law
