As a result, tort law is constantly changing over time. Originally, there was only trespass to property, and trespass to battery (= touching someone without consent). There was a two tiered society- rich and poor, where the rich made the law, so the two laws- don"t touch me and don"t touch my property make sense. Because its common law, if you could fit yourself into a trespass to property or trespass to property, you could get a remedy in tort law. Then someone came and said they had a case that was neither: the wrong doer didn"t come on their land, but it was like they came on his land, because it had the same damages. He won, so then there was a third torte- nuisance- intentionally harming the enjoyment of someone"s land. "its not trespass to the person, but its like he punched me in the face.
