No consensus on whether or not to have it. Actually appears in three places: 3/5th compromise: The senate is represented based on population. Southern house seats 33 47: 20 year legislative delay: No laws regarding slavery could be passed within the first 20 years: fugitive slave clause: There is a legal obligation to return escaped slaves (as you would with property) Votes from state legislatures (women did not have the right to vote for state legislatures) 19th amendment 1920 gave women the right to vote. Federalism: power divided between national and state governments. Exclusive federal powers: enumerated (print money, declare war) Exclusive state powers: reserved (issue licenses, regulate commerce) Shared powers: concurrent (collect taxes, build roads) At the time, no historical precedent for federalism. Divides power national and lower levels.
