The role of the victim in the adversarial system. The canadian criminal justice system is founded on the adversarial model: advocates for the prosecution (the state) and the defense, represent their positions before an impartial and fair judge and jury. Certain provinces have given the victim no say at all. Victims are expected to testify against the accused in sexual assault cases. Private prosecution: allows any citizen to appear before a jp to lay an information (alleging a criminal act took place, who did it etc. , these are very rare because people do not know it is an option. In 2015 the harper government enacted the victims" bill of rights which grants victims rights in 4 areas. Access to information about the police investigation (within reason) Access to information about the offender"s bail/release: protection. The police have to take the victims security seriously.
