Not only governments used racist and discriminatory laws at a disadvantage, but discrimination was rampant in the private sectors. In common law, individuals are free to pursue their own course of actions, to do what they want, as long as their actions are not prohibited by law - statutes. Bought 2 tickets for him and girlfriend, but can"t sit in their seats because they are not of colour. Court ruled in favour of black person, but because bought the tickets and is in breach of the contract when he already bought the tickets. Decided to go to a particular bar to have a beer, but when they went, the waitress was told not to serve people of colour. Case went up to the scc, the scc ruling was that it"s a commercial liberty (allows to serve anybody that they wish) Was rejected service at hotel because he was black. Based on commercial liberty, claim was rejected.
