Trials used to be a form of entertainment. In jury trials, there is a complaint that judges instructions are too technical. Dif cult for judges to translate highly technical law into words everyday people can understand. Tendency nowadays not to have public trials. Basic elements of the ovol: adversarial system. Bring case before judge (provincial courts dont have jury trials, superior courts do, but most crim cases in front of provincial) Fact nding is dif than truth telling- people tell story in manner that puts them in the best light. Hope that facts will emerge through the con ict of the two sides: seperation of powers. Courts are supposed to be impartial, impenetrable to political interference. In the us, judges are elected - answer to people every 4 years.
