Tort: a civil wrong, not arising from a breach of contract or other agreement or a breach of a legal duty, proximately causing another person harm or injury. Civil action- me suing you, you suing the government. We are not talking about criminal law in this. Tort: wrongful act or infringement on a person"s rights that leads to civil liability. Purpose of tort law: to provide a remedy (damages) for injury to a protected interest. To make yourself whole (make them pay for your injuries); enable you to sue them and pay for their hospital bill for you. Injured you, you have receipts, medical bills, and time out of work. Tangible: general: for non monetary aspects, such as pain, suffering, and mental anguish, reputation. Damages available in tort actions: punitive: punish the wrongdoer and deter similar conduct in the future. They can also punish the wrong wrong doer.
