Discrimination 10/22/2013 Title IX Discrimination of education and part of civil rights act of 1964.  Must have same sports for man and women Title VII Discrimination in the workplace Equal Employment Opportunity Laws Can not hire or fire based on race (White, black, Asian pacific, Hispanic) sex, Religion (employers don’t  accommodate for religious practices balance reasonable accommodation v undue burden) or national origin Sexual orientation discrimination is not protected under the law yet. Some states have this law but federal  law does not say this All aspects of working relationship: promoting, hiring, firing, treating differently in workplace.  Proving discrimination cases Discriminatory treatment More overt, for ex if you only hire women Must prove motive. Someone heard you make a statement that you don’t want to hire men.  Intentional Disparate Impact Employer has a policy that at face value isn’t discriminatory, however statistically the policy will impact a  protected class.  Is it a business necessity to have a high school diploma to perform well at the next level if more black  people don’t have them compared to white people.  Intent does not matter EEOC Equal Pay Act Age Discrimination Americans with Disabilities Discriminatory Acts have short statute of limitations 180 days first bring complaint to state agency before to Equal opportunity commission.
