Many existing laws with various, unrelated, intents may constrain an individual"s freedom of expression but only as a side effect of the laws primary purpose. One example discussed in class involved motorcyclists that have been pulled over for not wearing a helmet. The motorcyclists may argue that they weren"t wearing a helmet because they were trying to express their disapproval with helmet laws. Although this may be true, the motorcyclists first amendment rights have not been violated because the primary intent of helmet laws involve safety and wellbeing not limiting first. The discussion topic was what does and does not constitute a first amendment. Topic b : explore the connection between rights in personal data and competition. Two pieces of regulatory legislation were discussed in class. The cfaa seems to focus on authorization rather than intent.
