Change in circumstance from the initial creation of the privity of contract: The world changed drastically in the 19th century. After the civil war, the great plains had been converted to grazing for massive herds of cattle. The original intention of the privity rule was to protect the butcher (producer) from lawsuits if his meat was bought by a consumer (of which he had every expectation to consume said meat) and resold to another. With the rise of cattle raised, slaughtered, and sold thousands of miles away this changed drastically to a world where manufacturers never met their consumers and instead used intermediaries.
