Federal government creates second national bank in maryland. Maryland opposed national bank, so created tax on all banks uncharted - only the national bank. Fed gov"t can create any entity it needs to operate gov"t. Supreme court was majority federalists at the time. Plessy was a man deemed white, black and bought a white ticket for train. Refused to sit in black section, state prosecuted him. Violates equal protection clause b/c he isn"t protected due to color of skin. Argues that the ruling is slavery: forcing to be somewhere based on color of skin. While 14th amendment requires equality in the political arena we are not equal socially. Not required to share restaurants, drinking fountains, trains, schools, etc. Weren"t getting the same materials, services, facilities, etc. Argued about the secondary effects of treating people differently by the color of their skin was something that impacted the psychology of the people and the way they evolved in thinking they were inferior.
