If you don"t adhere to these, the probation officer can file for a revocation of probation. The burden of proof is a preponderance of the evidence (less burden of proof) To keep violent criminals away from the rest of us. Demonstrate to society the crime should be avoided. States have to have enough money in the budget to have a rehabilitation program. Only the government can be the plaintiff in a criminal prosecution. The government needs to show that the defendant committed the act. ***only actus reas is necessary for some crimes.
